The wording sounds like lawyer speak to boost damage awards. Based on the advert included in the article, it doesn't look anything like the claims. She may deserve compensation if the image was licensed for one campaign only. But not $10M, something like 2x a normal modeling fee.
She won't win, and if she does like you said she will be entitled to the contractual portion plus maybe some more. I think she figures she's entitled to the amount spent and/or gained from the ad campaign which isn't gong to happen.
